Terms and Policies   Tomken Machine, Inc. is a Colorado corporation, organized in 1989 to meet the needs of off-highway enthusiasts. Our companies mission is to research, design, and manufacture new and better parts and to provide our customers with the finest products available. Superior engineering and workmanship together with the highest quality materials means the best product to you, our customer.   Our commitment to you is to take pride in everything we produce. The trained specialists at Tomken understand what today's four wheelers need. Our corporate manufacturing facility is just north of Buena Vista, Colorado in the heart of the Colorado Rockies. Our backyard is one of the best testing grounds in the world, and all of our products are thoroughly evaluated on and off road before they are put into production.   Terms: We accept Visa, MasterCard, & Discover, cashier's check or money order. No C.O.D.'S or personal checks.   Service: We strive to ship within 5 days. However, our product line is large and varied and it may not be possible to ship special orders immediately.   Shipping: If shipping instructions are not received with an order, we will ship using the least expensive or most practical source, according to size and weight. We ship by United Parcel Service, and to comply with packaging regulations, your order may be received in more than one parcel.   Claims: All orders are carefully packed, however, mishandling by carrier en-route can result in damage. The carrier has responsibility for the shipment from the time it leaves our warehouse until it is delivered to you. Title to merchandise passes to the customer upon delivery from Tomken to the carrier. All damage and postage claims should be made to the carrier, not to Tomken.   Returns: There will be no credit on returned merchandise without prior permission from the Tomken General Manager. Merchandise must be returned prepaid and insured, and a claim must be made within ten (10) days from receipt of merchandise. The original invoice must accompany all returns. A 20% restocking fee is charged on most parts returned for credit or refund unless merchandise is proven to be defective or was shipped in error by Tomken. Claims will be handled in a just and prompt manner.   Warranty and Guarantee: All merchandise manufactured by Tomken is 100% guaranteed against material or workmanship defects. Replacement is limited to parts manufactured by Tomken. All merchandise distributed by Tomken is guaranteed in accordance with the manufacturers' own warranty terms.   Please Read, Very Important!   Product Disclaimer: While Tomken stands behind its engineering and workmanship 100%, we cannot accept responsibility or liability for breakage or failure of parts as a result of rugged off-road use or reckless highway driving after modification of your vehicle. As an off-highway enthusiast, you should be aware that modifying your vehicle by the addition of certain after-market parts may under some circumstances void your original dealer warranty. If, after considering all the possible limitations of modification, you decide to go ahead, by all means do so.
